Assistant Attorney General, Administrative Law | Texas Attorney General

The Tone:
This is a full-time role at the Texas Attorney General, located in Austin, Texas. The Office of the Attorney General (OAG) is a large state agency with over 4000 employees throughout Texas, serving as the State’s law firm and providing exemplary legal representation. Lawyers in the Administrative Law Division (ALD) are critical to defending the interests of Texas by representing dozens of state agencies in court on a variety of issues fundamental to people across the state. This position offers the opportunity to manage your own dockets, work on important and diverse legal issues, and make a positive difference in public service.

The TL;DR

• Mission: Defend the interests of Texas state agencies through legal representation in administrative, state, and federal court proceedings.

What You’ll Actually Do
• Court Representation: Represent state agencies in state and federal district and appellate courts, handling matters such as judicial review of agency orders, enforcement proceedings, actions challenging agency rules and statutes, and non-party subpoenas.
• Litigation Management: Independently manage a diverse litigation docket with moderate to general supervision, serving as first chair in court and coordinating legal activities.
• Legal Drafting: Draft comprehensive legal documents, including pleadings, motions, briefs, memoranda, and discovery, while participating in trial and appellate advocacy.
• Advisory Services: Provide essential legal advice, counsel, and assistance to state agencies, and may represent the Office of the Attorney General in open records litigation.
• Administrative Hearings: Represent state agencies in administrative enforcement proceedings before the State Office of Administrative Hearings and analyze factual and legal issues through legal research.

The Must-Haves
• Background: Graduation from an accredited law school with a J.D., licensed as an attorney by the State of Texas, and a member in good standing with the State Bar of Texas, eligible to practice law by start date.
• Experience: At least one year of full-time experience working as a licensed attorney for an Assistant Attorney General II, or two years for an Assistant Attorney General III, demonstrating experience in legal work.
• Skills: Legal research, writing, and analysis; conducting investigations, mediation, and negotiations; identifying and solving complex legal problems; prioritizing workloads and managing multiple tasks; effective oral and written communication; and exercising sound judgment and effective decision making.
• Bonus: One to five years of civil litigation experience, including appellate and brief-writing; experience in administrative law; experience interpreting and applying open records, open meetings, and other open government legislation; and admitted to practice in Federal District Courts.
