Contract Manager | Hitachi
The Tone:
This is a full-time role at Hitachi Rail, located in Toronto, Ontario, Canada. Hitachi Rail operates globally, contributing to digital transformation and technology, particularly in the rail sector. This position is vital for the Signaling and Rail Solutions Line of Business in the Americas region. The role ensures robust contract and commercial management for bids and projects, strategically minimizing risk and optimizing commercial outcomes for the company.

• Mission: Manages and drives contract and commercial management for bids and projects, identifying opportunities to minimize contract risk and maximize returns while ensuring contractual compliance.
What You’ll Actually Do
• Risk Management: Identify opportunities to minimize contract risk, plan comprehensive commercial risk mitigation strategies, and proactively manage project commercial and contracting risks, coordinating necessary mitigation measures and contractual insurance requirements.
• Bid & Project Strategy: Provide commercial assessment of terms, conditions, risks, and assumptions during the Bid Phase, and develop appropriate strategic commercial approaches tailored to various contract types, such as FFP or T&M.
• Contract Compliance & Impact Management: Monitor, support, and report on all customer, JV/Partner, and sub-contractor contract-related commercial impacts and risks, including placing customers on notice for delays/impacts, managing contract changes/credits, or defending against assertions/claims.
• Contractual Documentation & Procedures: Develop and implement comprehensive contract management infrastructure and procedures, ensuring the maintenance of contractual records and documentation, contract correspondence, contractual changes, status reports, and other project-related documents, conducting periodic audits as needed.
• Subcontractor & Variation Management: Commercially and contractually manage subcontractors after subcontract award, serving as the primary point of contact for contractual matters, and supporting the Project Manager with proper negotiation and management of variation orders to maximize returns.
The Must-Haves
• Background: Bachelor’s degree in business, law, finance, or a related field. Works within the railway, infrastructure, or construction industry in contract and commercial roles.
• Experience: Minimum 5 years’ experience in contract and commercial roles within a complex technical or engineering-based organization, specifically managing medium to large-scale design/build or EPC projects.
• Skills: Expertise in contract risk identification and mitigation, commercial assessment of terms and conditions, claims preparation support, negotiation and management of variation orders, and commercial and contractual management of subcontractors.
• Bonus: Post graduate qualifications in construction law, dispute resolution, or contracts management are highly desirable. Alternatively, tertiary qualifications in an engineering discipline (Electrical, Mechanical, or Civil), Construction Management, or Quantity Surveying, preferably RICS qualified.
